The website www.pareidoliadesign.com is an online website and store of exclusive and original Pareidólia products.

All contents of this online website are the property of the Pareidólia brand and are protected by intellectual property law.

1 - use of our website

By using this website and placing orders through it, you undertake to:

1. Use this website solely to carry out legally valid inquiries or requests.

2. Do not make any false or fraudulent orders. If it could reasonably be considered that if there is a request of this nature, we will be authorized to annul it and inform the relevant authorities.

3. Provide us with your email address, postal address and/or other contact details truthfully and accurately. Likewise, you are aware that we can use your information to put us in contact with you if necessary (see our Privacy Policy). If you do not provide us with all the information we need, we will not be able to process your request.

When placing an order through this website, you declare that you are over 18 years old and have the legal capacity to enter into contracts.

2 - products availability

Most Pareidólia pieces are made to order. See the “Shipping and Returns” section.

3 - delivery

Unless unforeseen or extraordinary circumstances occur, we will send the order consistent with the product/s related to each Shipping Confirmation at the time marked by us according to the shipping method selected. Please consult the “Shipping and Returns” section.

4 - transmission of risk and property

The risks of the products will be assumed from the moment of delivery. You will acquire ownership of the products when we receive full payment of all amounts due in connection with the products, including shipping charges.

5 - price and payment conditions

The available payment methods will be displayed on our website. We do not accept any other payment method besides those mentioned. You can pay for your products using Bank Transfer/MB WAY and via Paypal.

If the Final Consumer chooses to pay by Bank Transfer, we will only start processing the order after we have received an e-mail with proof of the value and the completion of the payment. Once two calendar days have elapsed after placing the order, and if we have not received any payment, the order will be cancelled. The purchase price of the products and the transport costs, as indicated in the order form, will be charged to the current account when the purchased products are actually shipped.

The prices on the website are VAT exempt (special exemption regime foreseen in Article 53 of the VAT Code), but exclude shipping costs, which will be added to the total amount due as stated at the end of our purchase process. Prices may change at any time, but possible changes will not affect orders for which we have already sent an Order Confirmation. Once you have selected all the items you want to buy, they will have been added to your basket and the next step will be to process the order and make the payment. To do this, you must follow the steps of the purchase process, filling in or checking the information requested at each step. Likewise, during the purchase process, before making the payment, you can modify the data of your order.

6 - shipping and returns

ON REQUEST / BESPOKE

Most of our pieces are made to order. They are handmade, one by one, in our workshop located in Ajuda, Lisbon. No two pieces are exactly the same, since the production process itself implies that each one has small variations, for example in the glaze color and texture after firing, which makes them totally unique objects.

PRODUCTION TIME

Production times for each piece are approximately 4 to 8 weeks once the order is confirmed. This may vary depending on the size and for special requests, please consult estimated times.

PACKAGING

All our pieces are properly packaged to guarantee that their transport is carried out in the safest way. To protect them when shipping, we double pack them.

SHIPMENTS

Pareidólia only processes an order placed by a customer after confirmation of the respective payment, so it cannot guarantee the availability of the articles until the beginning of said processing. The estimated date for dispatch of the products , after confirmation of payment, is one to three days (regarding products with imediate available stock).

Pareidólia only dispatches orders on working days. Thus, to estimate the delivery time of orders, weekends and holidays are not taken into account.

Any delay in the dispatch of items, in view of the estimated dates presented, does not confer the right to compensation.

Shipping costs will always be borne by the customer. In the final purchase process you will obtain the valuation of said postage. In the case of countries outside the European Union, the client will also be responsible for any charge, tax or fee set by the country of destination. Any expense caused by the non- acceptance of said charges will be borne by the client. Returns of shipments due to disputes originated by the client with their corresponding customs services will not be accepted (see changes & returns).

CHANGES & RETURNS

Our pieces are 100% handmade, made by order and specifically for each client, so we do not accept changes, cancellations or returns (returns will only be accepted due to transport incidents, see the next point). In the event of rejection of an order by the client in the event of a dispute with the customs office corresponding to the country of destination, Pareidólia will not accept said return nor will it be responsible for any expense or shipment derived from said disagreement.

INCIDENTS OR CLAIMS

All our shipments are insured against any possible incident. If your piece has suffered any damage during its transport, we will take responsibility for replacing said piece as soon as possible. The pieces must be reviewed within two days of receipt of the shipment. After that time, Pareidólia does not guarantee the treatment of claims or incidents.

7 - guarantee

The products we sell can often present the characteristics of the natural materials used in their manufacture. These characteristics, such as variation in texture, glaze, shape and color, will not be considered defects. We only make the highest quality products, but natural characteristics are unavoidable and must be accepted as part of the individual appearance of the product.

We provide installation services for wall pieces and tile panels, where we use appropriate tools for each situation or piece. If the customer prefers to hire any other installation company, Pareidólia is not responsible for any fixing systems used by other entities/companies or damage to the pieces caused by other entities/companies.

8 - industrial and intellectual property

You acknowledge and agree that all copyright, trademark and other industrial and intellectual property rights on the materials or content provided as part of the website correspond at all times to Pareidólia or to those who granted us a license for its use. You may use said material only in the manner expressly authorized by Pareidólia or by those who granted us a license for its use. This will not prevent you from using this website to the extent necessary to copy your order information or Contact details.

9 - written communications

The applicable regulations require that part of the information or communications that we send you be in writing. By using this website, you agree that the majority of such communications with us will be electronic. We will contact you by email or provide information by posting notices on this website. For contractual purposes, you agree to use this electronic means of communication and you acknowledge that all contracts, notifications, information and other communications that we send you electronically comply with the legal requirements of being in writing. This condition will not affect your rights recognized by law.

10 - notifications

The notifications that you send us should preferably be sent through our contact form, unless otherwise stipulated, we may send you communications either by e-mail or to the postal address provided when placing an order.

It will be understood that the notifications have been received and have been correctly made the moment they are posted on our website, 24 hours after an email has been sent, or three days after the postage date of any letter. To prove that the notification has been made, it will be enough to prove, in the case of a letter, that it had the correct address, was correctly sealed and that it was duly delivered to the post office or to a mailbox and, in the case of an email , that it was sent to the email address specified by the recipient.

11 - assignment of rights and obligations

The contract is binding on both you and us, as well as our respective successors. You may not transmit, assign, encumber or in any other way transfer a contract or any of the rights or obligations derived from it, without having obtained our prior written consent. We can transmit, assign, encumber, subcontract or in any other way transfer a contract or any of the rights or obligations derived from it, at any time during its validity. To avoid any doubt, said transmissions, assignments, encumbrances or other transfers will not affect the rights that, if applicable, you, as a consumer, have recognized by law, nor will they nullify, reduce or limit in any other way the guarantees, both express and implied, that we could have given you.

12 - our right to modify these terms

Pareidólia reserves the right to change these conditions of use and contracting, without prior notice, as well as to modify at any time the information and commercial offer presented on products, prices, promotions, commercial conditions and services.

The modifications introduced will not be retroactive.If you do not agree with the modifications introduced, we recommend that you do not use our website.

13 - applicable law and jurisdiction

The use of our website and the contracts for the purchase of products through said website will be governed by the Portuguese law. Any controversy that arises or is related to the use of the website or with said contracts will be submitted to the non-exclusive jurisdiction of the Portuguese courts and tribunals. If you are contracting as a consumer, nothing in this clause will affect the rights that as such You are recognized by current legislation.

14 - comments, suggestions, complaints and claims

All your comments, suggestions, complaints or claims will be well received.

For this purpose, the complaint must be formalized by email sent to the address info@pareidolia.com. In the complaint, the Customer must expressly indicate the reasons for his complaint, always mentioning the order number.
